Please read these Terms of Use ("Terms") carefully before using the CoffeeTells mobile application ("App"). By downloading or using the App, you agree to these Terms. If you do not agree, you must not use the App. The App is offered for entertainment purposes only and is not intended to provide professional advice. Your use of the App is also subject to our Privacy Policy (available on our website or in the App), which explains how we collect and use your information.
1. Definitions
- "App" means the CoffeeTells mobile application.
- "Input" means any content you submit to the App (for example, a photo of a coffee cup that you upload).
- "Output" means any AI-generated text story, image, or other content that the App produces and provides to you in response to your Input.
- "We," "Us," or "Our" refers to CHEATVPN LTD, the publisher of the App, a company based in the United Kingdom. (In these Terms, CHEATVPN LTD is also referred to as the "Company.")
- "You" or "User" refers to you as the person using the App.
2. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your country/region) to use this App. By using the App, you represent and warrant that you meet this age requirement. If you are under the required age, or if your use of the App is prohibited by applicable law, you must not use the App. The App is intended for entertainment purposes only and is not a source of professional advice (medical, legal, financial, or otherwise). Always seek the advice of a qualified professional for such matters; do not rely on any Output from this App for important decisions.
3. Description of the Service
- Uploading a Photo & AI Generation: CoffeeTells allows you to upload a photo of a coffee cup and receive an AI-generated "coffee reading." Our backend servers process your photo using artificial intelligence technologies (including third-party AI services like the OpenAI API). Based on your uploaded coffee cup image, the App generates an Output, which may include a textual story or interpretation and/or a generated image related to your coffee cup. This Output is displayed in the App for you. You may save the Output to your device if you wish.
- Accounts and Purchases: You are not required to create a user account or provide login credentials to use the core features of the App. The App does not require a traditional username/password sign-up. However, for your convenience, we may offer an optional "Sign in with Apple" feature to allow you to securely authenticate and sync your content or settings across devices. Using Sign in with Apple is optional and solely for your benefit (e.g. to restore purchases or saved readings on another device). All purchases, including subscriptions or one-time payments for premium features, are handled through Apple's in-app purchase (IAP) system. (No external payment methods are used.)
- Coffee-Cup Images Only: The App is designed specifically for coffee cup reading, so only photos of coffee cups are accepted for processing. We use automated image recognition checks to determine if an uploaded image actually contains a coffee cup. If you upload an image that does not appear to depict a coffee cup, we will not process it and will delete it from our servers after the brief processing needed to make that determination. Non-coffee images are not retained in storage. We only retain actual coffee-cup images as necessary to provide the App's functionality (for example, to generate your Output or to allow you to revisit a saved reading). Edge cases can occur in the detection process, and we reserve the right to remove or refuse any uploaded image that we determine (in our sole discretion) is not an appropriate coffee-cup photo.
- No Improper Use of the Image Feature: Please note that attempting to use the image upload feature with anything other than a coffee cup photo is against the intended use of the App. We may take action (including content removal or suspending service) if we detect misuse of the image upload feature, as further described below.
4. User Content & Acceptable Use
By using CoffeeTells, you agree to use the App in a responsible manner. We have no tolerance for objectionable content or abusive behavior. Specifically:
- Your Rights to Upload: You represent and warrant that you own or have all necessary rights and permissions to upload any photo or other content you submit as Input. Do not upload content that you do not have the right to use or share.
- Prohibited Content: You must not upload any content that is unlawful, harmful, violent, pornographic, threatening, defamatory, infringing on anyone's intellectual property or privacy rights, or otherwise objectionable or abusive. This includes content that is hateful, harassing, discriminatory, or exploitative. We reserve the right to refuse or delete any Input that we deem to violate these standards.
- No Misuse of the App: You agree not to misuse the App. You must not attempt to reverse engineer or decompile the App, bypass or interfere with any security or access controls, or exploit the App in any fraudulent or deceptive manner. For example, you must not use the App to generate content for harmful purposes, launch automated scripts or bots to overload the service, or attempt to use the AI output to spread misinformation or malware.
- Compliance with Laws: You are solely responsible for your use of the App, including both the Input you provide and how you use or share the Output generated for you. You agree to comply with all applicable laws and regulations in your jurisdiction when using the App and any content obtained from it. This includes laws regarding privacy, intellectual property, and the export of data or software. If the Output or your use of it is subject to any regulations (for example, if you share it publicly), you are responsible for ensuring compliance.
- Reporting and Enforcement: If you encounter any misuse of the App or any content (Input or Output) that you believe violates these Terms (for example, someone using the App to create objectionable content), please report it to us. You can contact us through the App's support/feedback feature or via email at support@coffeetells.app. We will review and address reported violations as quickly as possible (generally within 24 hours of receiving a valid complaint). We reserve the right to remove content, suspend or terminate any user's access to the App, and/or take other appropriate action if we determine that the user has violated these Terms or engaged in any behavior that we deem abusive, unlawful, or in violation of the spirit of the App.
5. Ownership; Licenses
- Your Input: You retain ownership of any original content that you upload to the App as Input (for example, your photos). We do not claim ownership over your Input. By submitting Input, however, you grant us a limited license to handle that content for the purposes of providing the service. Specifically, you give us a worldwide, non-exclusive, royalty-free, license to host, store, transmit, modify (e.g., process through our AI), and display your Input as needed to operate the App's features for you. This license is only for the purpose of running the App and improving or providing our services to you. We will not use your Input outside of this scope. (For example, we will process your coffee cup photo to generate a reading, and we might temporarily store it so you can view or re-generate your results, but we won't sell your photo or use it for unrelated purposes.)
- Generated Output: To the extent permitted by law, you own the Output that is generated from your Input. This means the creative story or image we produce for you is considered content that you have rights to use. We do not claim any ownership rights in the Output we provide to you. Our role is to facilitate the creation of the Output via our AI; once generated and delivered to you, the Output is yours to use as you wish, with no additional payment or royalties owed to us. Exception: If applicable law does not allow full ownership of Output to pass to you (for example, due to the nature of AI-generated content in certain jurisdictions), then you are granted a perpetual, worldwide, royalty-free license to use, reproduce, modify, and distribute the Output. In any event, we retain a limited license to the Output only to the extent necessary to store or display it within the App (for example, so you can view your generated story or image on your device) and to otherwise provide the service to you.
- Intellectual Property Notice: Aside from your Input and Output, all rights, title, and interest in and to the App (including but not limited to the app software, design, logos, and content provided by us) remain with us and our licensors. These Terms do not grant you any rights in the App itself or its underlying intellectual property, except for the limited right to use the App in accordance with these Terms.
- Content Removal: We reserve the right (but do not assume the obligation) to remove or disable any content (whether Input or Output) that, in our judgment, violates these Terms or any applicable law, or that we deem inappropriate for the service. This can include deleting non-coffee images (as described above) or any other content that breaches our Acceptable Use rules. We are not responsible for any loss of data that may result from such removal. If your content is removed and you believe it was a mistake, you may contact us to dispute the decision, but the final determination will be ours.
